Data Privacy at Apptix
Apptix has established a comprehensive privacy program designed to help us respect and protect your data privacy rights. This statement includes both Apptix’s European Union - U.S. Safe Harbor Privacy Statement and the Website Privacy Statement.
EU-US Privacy Shield Statement
This EU-US Privacy Shield Statement applies to data about an identified or identifiable individual that are within the scope of the E.U. Directive, received by Apptix from the European Union, and recorded in any form. This includes personal data Apptix collects from EU data subjects or receives from its affiliates located in the EU, such as information regarding service requests, service orders, handling orders, for the purpose of delivering services and processing payments. Apptix has certified compliance with the EU-US Privacy Shield Framework to the United States Department of Commerce.
When Apptix acts solely as a data processor on behalf of its customers, Apptix acts only on the instructions of its customers and does not control or share such personal data without direction from the customer. Apptix's obligations with respect to such personal data, is as defined in its agreements with its customers, and is not covered by this Privacy Statement. Apptix receives such personal data from the EU as an agent of the customers. The customers will remain responsible for the personal data that they collect and process and for the compliance with applicable data protection laws.
Where Apptix collects personal data directly from individuals in the EEA, it will inform them about the purposes for which it collects and uses the information about them, and choices and means, if any, of limiting such use and disclosure.
Before disclosing personal data it collects Apptix will give such individuals the opportunity to choose whether their personal data will be disclosed to a third party or used for a purpose incompatible with the purpose for which it was originally collected. If Apptix collects sensitive personal information as defined by the EU-US Privacy Shield Principles, it will seek affirmative or explicit authorization if the information is to be disclosed to a third party or used for a purpose other than its original purpose. Apptix will provide individuals with reasonable opt-in/opt-out mechanisms to exercise their choices.
Onward Transfer (Transfers to Third Parties)
If Apptix is going to transfer personal data to a third party that is acting as an agent, it will enter into a written agreement with such third party requiring that the third party provide at least the same level of privacy protection as is required by the relevant principles. Third parties that Apptix may engage include, but are not limited to, invoice processing services, public relations and marketing companies, outsourced call center telephony services, etc. In cases of onward transfers to third parties of data of EU individuals received pursuant to the EU-US Privacy Shield, Apptix, Inc is potentially liable, unless Apptix proves that it is not responsible for the event giving rise to the damage. Apptix may be required to disclose an individual’s personal information in response to a lawful request by public authorities, including to meet national security or law enforcement request.
You may contact Apptix using the contact information below to learn whether or not your personal data is found in the databases that Apptix maintains that are subject to this policy, and to request corrections, amendments or deletion of such data. This right applies only to personal information about you and is subject to other limitations as defined by law, or where the burden or expense of providing access would be disproportionate to the risks related to the privacy of the individual or where the rights of other individuals would be violated. You will need to provide sufficient identifying information, such as name, address, birth date, and social security number. Apptix may request additional identifying information as a security precaution. In some circumstances, we may charge a reasonable fee, where warranted, for access to personal information and will respond within a reasonable timeframe.
Apptix takes reasonable precautions to protect personal data subject to this policy from loss, misuse and unauthorized access, disclosure, alteration and destruction.
Apptix takes reasonable steps to ensure that personal data subject to this policy is reliable for its intended use, accurate, complete, and current; Apptix will take these reasonable step for the duration the data is present in Apptix systems.

Apptix has further committed to refer unresolved privacy complaints under the EU-US Privacy Shield Principles BBB EU PRIVACY SHIELD, a non-profit alternative dispute resolution provider located in the United States and operated by the Council of Better Business Bureaus. This EU-US Privacy Shield Policy may be amended from time to time, consistent with the requirements of the EU-US Privacy Shield Principles. A public notice will be posted for the appropriate time on the Apptix Site if this policy is changed in a material way.
Apptix Website Privacy Statement
Apptix Keeps Personal Information Private and Apptix Limits Use of Personal Information
The information Apptix receives depends upon what you do when you visit the Apptix website (as detailed below) and how you use the Services. Unless Apptix has your permission, Apptix does not share with third parties any personal information you provide to Apptix. By “personal information” Apptix means information that can be used to identify or contact you, such as your name, e-mail address, mailing address, telephone number, fax number, and billing, payment, usage, credit and transaction information (including credit card numbers, account numbers, and social security and taxpayer identification numbers). By “third parties” Apptix means anyone who is not directly involved in the maintenance or running of the Apptix website or the Services.
Apptix uses personal information you provide to Apptix (on the Apptix website, or by email, fax, or correspondence, or the use of the Services) strictly for the purposes for which you have provided it. For example, if you request information about a product and provide us with contact information (which may include personal information, such as an e-mail address, mailing address, or phone number), Apptix will use that information to contact you regarding your request. To measure our visitors’ and customers’ interest in and use of various areas of the Apptix website, and Apptix’s products and the Services, Apptix may rely upon aggregate information. By “aggregate information” Apptix means information that does not identify you, such as web pages viewed on the Apptix website. With this aggregate information, Apptix may monitor visitor traffic patterns, usage of the Apptix website, and undertake to improve the Apptix website’s layout and design. Apptix may also use aggregate information to assist in the marketing of Apptix’s products and the Services.
If you are a customer of Apptix, Apptix uses your personal information to provide, confirm, change, bill, monitor, and resolve problems with the Services or their quality. Apptix may also use your personal information to develop, market, and sell Apptix products and the Services to you.
