Acceptable Usage Policy
Apptix, ASA is a provider of turnkey private label
hosted business messaging, collaboration and
communication solutions for service providers, which
invests it with certain legal and ethical
responsibilities as to the use of those Services and the
equipment that supports its Service offerings. Apptix
has developed a policy of on-line conduct, or Acceptable
Usage Policy (AUP), that is supplemental to each
Customer's Agreement and expands upon certain terms and
conditions contained therein. By using Apptix's
Services, our Customers, as well as Customer's users
and/or customers, agree to comply with the AUP. Apptix
Customers are expected to take the necessary steps to
insure, to the best of their ability, that these
guidelines are routinely followed by their customers,
subscribers and/or users, to help insure the continuing
availability and overall success of the Internet as a
source of virtually unlimited private, public,
commercial and non-commercial information and products.
Apptix expressly reserves the right to suspend or
terminate a Customer's access to the Services if, in its
judgment, a Customer has inappropriately used the
Services or engaged in illegal or prohibited activities.
Customer acknowledges and understands that Apptix
exercises no control over the content of the information
passing through our system or through Customer's web
site (s). Customer acknowledges and understands that
Apptix does not monitor, review, edit or take
responsibility for any information that Customer or its
users create, access or disseminate, that it is the sole
responsibility of Customer to insure that any
information it and its users receive and/or send is in
compliance with all applicable laws, regulations and
this AUP. Customer will not engage in, nor will it
permit any persons using Customer's on-line facilities
and/or services to engage in, illegal or prohibited
activities. Specific activities that are prohibited
include, but are not limited to:
- Threatening harm to people or property, or otherwise
using the Services to employ, post or transmit
defamatory, malicious, obscene, harassing, or abusive
language.
- Violating the U.S. export control laws for technical
information or software.
- Misrepresenting products and/or services.
- Violating the Intellectual Property rights of others, to
include copyrights, trademarks, trade secrets, service
marks, and patents.
- Forging or misrepresenting message headers, return
mailing and Internet protocol addresses to mask the
identity or contact information of the sender.
- Violating the privacy rights of others, including,
without limitation, the unauthorized collection and
distribution of personal information not permitted by
law.
- Assisting persons engaging in any of the prohibited
activities referenced herein. If Customer becomes aware
of Prohibited Activities, Customer will use its best
efforts to correct the Prohibited Activity immediately,
including, if necessary, limiting or terminating User's
access to Customer's web site and services.
Use of Material
The Customer is expected to use its site and access to
the Internet properly and responsibly. Due to the
special system controls, requirements and procedures
associated with adult oriented sites, Apptix prohibits
websites that contain what is commonly acknowledged as
adult graphic content, or pornographic materials, to
include child pornography, links or distribution of
passwords to adult websites, banners advertising adult
websites, and sex-related merchandise. Customers in
violation of this policy may be terminated without
notice.
It is the sole responsibility of the Customer to ensure
that any and all information appearing on, or
disseminated by, their website are either materials
found within the public domain (having lost or never had
copyright protection) or works of Customer's own
creation. Copyrighted materials include works of art,
photographic images, video, music, computer software and
any other works fixed in a tangible medium, and may not
be used for commercial or non-personal use in any way
whatsoever, without the authority of the owner of
copyright. Customer assumes all risks in determining
whether any information is or is not material to be
found in the public domain. Upon receipt of a proper
notice that Customer's materials are a copyright
infringement, Apptix will require that the offending
materials be removed immediately, or access will be
blocked to that portion of Customer's content that
infringes another's copyright. Repeated violations of
copyright laws may result in the termination of
Services.
In the course of providing turnkey private label
solutions to its Customers, Apptix will acquire, store
and transmit Customer information that may be regarded
as private or confidential. Any Customer information
that Apptix may collect, to include, without limitation,
Customer's name, address, telephone numbers, information
on corporate officers or personnel, credit card
information and numbers, status of accounts, the choice
of Hosting Services, account logs, is done only for the
purposes of initiating an account, billing, customer
service and management of those services, or to fashion
offers of additional services. Apptix will not share or
disclose Customer information with any other company,
individual, organization or agency, without the prior
written consent of the Customer in question, except as
may be required by law. Apptix will, however, cooperate
with law enforcement agencies, but only to the extent
required under law, in claims or investigations of
illegal activities. Any personal information that
Customer places on its website is done at its own risk,
and is therefore excluded from the above considerations.
Apptix shall not knowingly collect information on
individuals under the age of eighteen years.
The Internet community does not appreciate unsolicited
e-mail from any source. This is the electronic
equivalent of "junk mail," and is also referred to as
SPAM. Spamming is the sending of unsolicited e-mail to
people or entities unknown to the sender. If you do not
know the recipient, or do not have the prior consent of
recipient to send the message, then you are spamming.
Spamming also includes sending unsolicited advertising
or commercial messages in bulk, which can quickly
disrupt the services of a Host. For this reason,
spamming is strictly prohibited, as is the provision of
any software that facilitates or enables SPAM. Other
related and equally prohibited activities include:
Mail-bombing, the sending of multiple messages to the
same e-mail address with the same basic contents;
Trolling, posting messages designed to elicit numerous
responses; unauthorized subscription of another's name
to mailing lists of any kind; storing, using or
distributing tools that collect e-mail addresses for the
purposes of bulk mailing, or that contain viruses,
worms, Trojan Horses, and other means that otherwise
compromise the integrity and security of another's
equipment, system, or service.
